Federal Court rules CDC eviction moratorium is unlawful

A federal appeals courts has said the CDC’s eviction moratorium is not legal. Judges on the 6th Circuit Court of Appeals out of Cincinnati sided with a lower court on Friday and ruled the CDC overstepped its authority by halting nationwide evictions during the pandemic.

They notes such decisions should be made by elected representatives and not by executive branch bureaucrats. The mandate has protected tenants who have lost income due to the pandemic from being evicted from landlords and property owners due to public health reasons.

Last month, the Supreme Court rejected an emergency request from landlords to get the eviction ban lifted. Opponents argued the mandate put undue pressure on landlords, who have lost more than $13 billion a month.

The CDC recently extended its eviction ban to July 31.
